Casey Defense Team Suffer Major Setback

Judge Stan Strickland on Wednesday, December 16th, denied two motions filed by Casey Anthony defense team and granted one motion by the prosecution.

Anthony who is charged with first degree murder in the death of her two-old-daughter, Caylee, also faces check fraud charges.

Her defense team had filed a motion to have nine of the check fraud charges dropped, arguing that they constitute double jeopardy.  However, Strickland disagreed, and denied the motion without explanation.  This means that Anthony will now face trial on all 13 counts for check fraud on January 25th 2010, unless a plea deal is worked out.   Among the charges faced in the fraud case, Anthony is accused of stealing checks from her former friend Amy Huzienga, and cashing them.

Strickland also denied the motion by Anthony’s defense that, tapes of their client during family visits be destroyed.

Strickland granted the prosecution’s motion to disallow an illegally recorded interview between an EquuSearch volunteer and the defense investigators from being being used or disclosed.  The judge is yet the rule on the defense motion filed which charge that the death penalty is unconstitutional in the first degree murder case of their client, Casey.

Anthony remains in an Orange County Jail charged with first degree murder in the death of her daughter, Caylee.  The two-year old’s remains were found just over one year ago in a wooded area near to the Anthony family home.   Anthony has maintained her innocence and has said that Caylee was kidnapped by a baby sitter, although no evidence has been found to date, to support this claim.

If convicted, Anthony could face the death penalty.   The first degree murder trial is expected to get underway in Summer 2010.
