Teen Arrested in Orlando Hospital, Charged with Attempted Murder

A teenager who exchanged gunfire with two St. Cloud police officers two weeks ago, then turn his AK-47 rifle and shot himself in the head, was arrested at the Orlando Regional Medical Center on Friday morning.

St. Cloud Police said, a warrant was signed and sealed for David A. Penney’s arrest on November 30.

Penney, 18, is accused of shooting at two officers as they attempted to apprehend him early on the morning of November 21, on Alabama Avenue. Several residents had called 911 to say, a white male was walking southbound on Alabama Avenue, shooting multiple rounds from an assault rifle.  As officers approached Penney, he fired upon their patrol hitting it multiple times.  Gunfire was exchanged with Penney, as the officers exited the patrol car. Police said, Penney then turned the assault rifle, an AK-47 and shot himself in the head.

Penney was found to have (2) AK-47 assault rifles in his possession.

The officers were treated for minor injuries and discharged from the hospital.

After shooting himself in the head, Penney was taken to the Orlando Regional Medical Center, in critical condition. He was in the ICU for several days.

Today, Penney was arrested at ORMC and charged with multiple counts:

– 4 Counts of Attempted Felony Murder
– 5 Counts of Shooting a Deadly Missile into an Occupied Dwelling, to include Unoccupied Vessels for 2 residences, and 3 vehicles
– 2 Counts of Resisting Law Enforcement with Violence
– 1 Count of Aggravated Battery on Law Enforcement Officer
– 2 Counts of Aggravated Assault on Law Enforcement Officer
– 2 Counts of Aggravated Assault
– 4 Counts of Criminal Mischief
– 1 Count of Discharging a Firearm in Public
– 2 Counts of Improper Exhibition of Dangerous Weapons or Firearms
– 2 Counts of Open Carry of a Firearm

Police said, once Penney is medically released from the hospital, he will be booked into the Orange County Jail while he awaits extradition to Osceola County Jail.
