A convicted felon is back in custody after he attempted to shoot a deputy with a stolen, concealed firearm while being rendered assistance on Saturday morning near Lake Underhill and S/B Chickasaw.
About 8:00 am, the Orange County Sheriff’s Office received a call regarding a passed-out male behind the wheel of a red van at the intersection of S/B Chickasaw and Lake Underhill.
The first deputy to arrive on the scene located the van and approached it to evaluate the situation, when he noticed the unresponsive male. The deputy opened the door to render aid and to determine the man’s condition. As he did so, the deputy noticed a bulge in the man’s clothing and was able to determine it was a firearm.
The man, later identified as Maximino Agosto, 26, woke up and looked at the deputy and reached for the firearm. The deputy immediately grabbed for Agosto’s arm in order to avoid being shot. A fireman who was already at the scene and at the door with the deputy, immediately jumped in to assist in detaining the man’s other arm and to gain control of the firearm.
A backup deputy officer who had arrived at the scene went to the opposite door of the van, broke out the side window and deployed ECD which had minimal effect on Agosto. However, the deputy was able to wrestle the firearm away. Agosto was forced from the van and deputies were able to subdue him, ultimately arresting him on the street.
Additional investigation by deputies determined that Agosto’s firearm was stolen and that he was a convicted felon.
Agosto, a Hispanic male, was booked into the Orange County Jail around 11:14 am on Saturday. He has been charged with aggravated assault on a Law Enforcement Officer, possession of a firearm by a convicted felon, possession of a stolen firearm and carrying a concealed firearm.
The investigation is ongoing.
