Judge Belvin Perry, earlier this week, requested the prosecution to release the aggravating factors under which they intend to prove that Casey Anthony deserves to die, if she is convicted of first degree murder in the death of her daughter, Caylee, reports Channel 6.
- the murder was committed in the commissioning of another crime, that is, aggravated child abuse for which Casey is also charged.
- the murder was especially heinous, atrocious and cruel
- the murder was cold, calculated and pre-meditated
- the victim, Caylee, was under 12 years, and
- Caylee was in familial custody–Caylee was with her mother when she was killed.
The Anthony defense team is not required to reveal until trial, the mitigating factors they intend to argue as to why Casey should not be put to death, if convicted of murdering her daughter.
Casey is charged with first degree murder in the death of her two-year-old daughter, Caylee. She maintains her innocence and has said that Caylee was kidnapped by a baby-sitter, named “Zanny”. After months of searching for the toddler, the child’s remains were found in December 2008 in a wooded area, a few blocks from the Anthony family home.
Casey sits in the Orange County jail awaiting trial which is expected to commence on May 9th 2011.
