Suspect Dies After Struggle with Orange County Deputies

At approximately 8:45 PM yesterday, September 30, 2008 Orange County deputies responded to the intersection of West Landstreet Road and the South Orange Blossom Trail in reference to a man running in and out of traffic, waving a belt over his head, and foaming at the mouth. A subsequent call to the Sheriff’s Office indicated the man was armed with a hammer and posing a danger to himself and motorists.

Deputies arrived at the scene and found the man in the intersection. The alleged hammer turned out to be a squeegee. When deputies attempted to make contact with the man he threw the squeegee down and assumed a fighting stance (fists clenched and up at his chest) towards one of the responding deputies. The defendant ignored repeated requests to get on the ground and made an aggressive move towards one of the deputies. The other deputy responded by deploying his electronic control weapon (ECW) which had minimal affect on the suspect who immediately got up and ran into traffic.

 

As the deputy continued in his attempt to secure the suspect the man charged at him. The deputy deployed his ECW again at which time the suspect indicated he would surrender. As the deputy approached the suspect to secure him the man began to pull away and struggle. The deputy deployed his ECW a third time in an attempt to arrest the man who got up and ran again.

 

As the deputy continued to give chase the suspect turned and ran at him. The deputy tackled the suspect, brought him to the ground, and attempted to handcuff him. A passerby/witness assisted in the violent struggle and helped the deputy take the man into custody.

 

Once in custody it became apparent that the man was having medical issues. Orange County Fire Rescue responded to the scene and transported the victim to Florida Hospital, Kissimmee. At approximately 7:20 AM today the Sheriff’s Office was advised that the suspect had died. The man has been identified as Jose Anibal Amaro, 6.30.63, 4107 West Vine Street, Kissimmee, Florida.

 

While this case is currently under investigation witnesses who were with Amaro prior to this incident advised that he had been consuming alcohol and cocaine earlier in the evening.

 

Because, in accordance with agency policy, the passing of Mr. Amaro is considered to be an in-custody death, D/S Andrew Reynolds, the deputy who deployed his ECW in an effort to apprehend a violent suspect, will be assigned to administrative duties for a period of one week. The Sheriff’s Office will continue with its investigation into this incident to affirm that all agency policies and procedures were followed. We will provide updates on this incident when they become available.

  1. Jose Anibal Amaro was the man that got tased three times and died in KISSIMMEE,FLORIDA.He was my cousin. I dont understand if he was overdosing on DRUGS why would YOU tased civilian THATS FOAMING FROM THERE MOUTH.The first thing that should come across the COPS mind this man needs medical attention.Like they said in police report he was foaming out of his mouth.This man that you read about was not a violent man.He was a loving and caring person.The news report stated that he was a criminal if he was. Why did he get he’s RIGHT BACK TO VOTE?Well that prove my point that no man should die of the hands of people who suppose to SAVE LIVES.I also think that the taser gun should be ban.

    “The U.S. Department of Justice has been investigating the Orange County Sheriff’s Office for its use of Tasers, after the agency reported a number of deaths involving the less-lethal weapon in the last several years.
    On Aug. 20, the Justice Department sent a list of recommendations to the Sheriff’s Office. The letter stated that using a Taser on people under the influence of drugs or behaving with “excited delirium” could cause death, according to a study by the National Institute of Justice. Among many other suggested policy changes for Taser use and training, the letter cautioned against shocking a subject multiple times and for longer than necessary.”
