Scott Issues New Rules Executive Order, Again

Two months after having his first attempt struck down by the Florida Supreme Court, Gov. Rick Scott on Wednesday issued another executive order aimed at reducing regulatory rulemaking activity and holding agency heads responsible for doing so.

In a 10-page order, Scott re-established the Office of Fiscal Accountability and Regulatory Reform within his office and ordered agencies under his control to provide the office with a bevy of information on new and proposed rules.

Scott’s order ribbed the high court’s five-member majority that ruled the governor could not prohibit agencies from promulgating rules to enact new laws passed by the Legislature.

The new executive order does not demand that all rules be cleared before they are implemented, but sets up a series of annual previews and reviews of rules either contemplated or on the books.
