Why should Florida residents attend this foreclosure prevention workshop?
Following foreclosure moratoriums by PNC Bank, Bank of America, J.P. Morgan Chase, and Ally Financial, the settlement of deceptive marketing charges by Wells Fargo Bank and the Attorney General’s investigation into faulty foreclosure practices at the Florida Default Law Group, the Law Offices of Marshall C. Watson, P.A.; the Law Offices of David J. Stern, P.A.; and Shapiro & Fishman, LLP., a Florida court ruled that banks must provide evidence of ownership when attempting to foreclosure on a property.
The recent decisions come amid critical reports of judicial foreclosures receiving “rocket docket” processing despite missing and/or poorly prepared documents. In October, Well Fargo admitted making mistakes in 55,000 foreclosure cases but promised to expeditiously address them. Now, a growing number of concerned homeowners- including many who have missed their mortgage payments are now moving to challenge their foreclosure proceedings.
Attorney Hicks states that these and a host of other lender-caused issues may result in the prevention of foreclosure eviction and encourages homeowners to learn the facts about their loan. He emphasizes that lender violations are typically found in 8 out of 10 reviewed loan files. “In many cases, lenders made violations that are actionable in a court of law,” said Hicks, “but 95% of homeowners don’t realize that they also have legal rights that could potentially prevent their foreclosure from continuing.” During the workshops, Hicks will provide free legal information about homeowners’ rights and the most recent discoveries in Florida foreclosure defense law. In addition, homeowners will receive information from participating non-profit agencies to help them better assess a practical course of action for their needs.
