Casey Anthony, set to walk out of jail on Sunday, will not have to answer questions under oath in the defamation suit filed against her until October.
On Friday, Circuit Judge Lisa Munyon denied a request by attorneys of Zenaida Gonzalez, the woman who is suing Casey for defamation, to require that she be deposed next Tuesday.
Gonzalez filed suit three years ago charging that she has been defamed after Casey claimed a nanny by that name kidnapped her daughter Caylee.
Gonzalez’s attorneys, concerned that Casey would leave the area upon her release from jail on July 17, served her with with documents in jail to appear at a deposition next Tuesday. An emergency motion was also filed on Wednesday to compel Casey to be deposed.
After a brief hearing before Judge Jose Rodriguez, with much of the time spent at side bar with Casey’s and Gonzalez’s attorneys on Friday morning, he recused himself from the case, saying that another judge will handle the matter.
Munyon, after listening to attorneys for both sides, set a date of October 8, for Casey to be deposed.
Meanwhile, Casey’s criminal defense attorneys are appealing her convictions on four counts of lying to a law enforcement officer. Last week a 12-person Pinellas County jury, who acquitted her of murdering her 2-year-old daughter, found her guilty of lying to law enforcement. She was sentenced to four years on each of the counts and fined $1,000 on each one.
Set to be released from jail on Sunday, there are rumors that Casey will be heading to live at the home of one of her criminal defense attorneys in Heathrow, Florida.
