Cousin of Former Hammocks HOA President Charged by Miami State Attorney

Miami-Dade State Attorney Katherine Fernandez Rundle announced the arrest of 32-year-old Kevin Leonardo Alzate as a part of the continued ongoing criminal investigation of theft, schemes to defraud and other criminal activities allegedly perpetrated by former members, employees, and vendors of the Hammocks Community Association, Inc. (the HOA).




Alzate is the cousin of former HOA President Marglli Gallego, who is now awaiting trial on 2 separate criminal cases related to the theft of HOA funds.

Kevin Leonardo Alzate is being charged with:

• 1 count Perjury by Contradictory Statements 3rd Degree Felony
• 1 count Fabricating Physical Evidence 3rd Degree Felony
• 1 count Resisting an Officer Without Violence 1st Degree Misdemeanor

“Not only did Mr. Alzate’s alleged activities allow our charged HOA Board members to continue their thefts, but the actions were a deliberate slap in the face to our Circuit Court Judges and our courts,” said State Attorney Katherine Fernandez Rundle. “Our laws and criminal procedures, created to facilitate justice, apply to everyone.”

As noted in the November 2022 arrest warrants which led to the charging of five individuals with a variety of financial crimes victimizing the HOA, there were several years of legal delays created by employees and members of HOA Board of Directors as well as the HOA’s legal team. The delays were designed to avoid producing the required financial documents necessary to facilitate the criminal investigation despite judicial orders to do so.

Alzate was an integral part of this scheme. He supplied notarized affidavits demanding payments from law enforcement that were used as a basis to refuse to comply with lawful production requests from law enforcement.

The South Florida HOA specifically supported costs of producing the documents by submitting sworn, notarized affidavits of Alzate. the HOA’s attorneys also repeatedly represented to circuit court judges that Alzate was the custodian of records. During a rule to show cause hearing against Alzate as the custodian of records for failure to produce HOA records, he swore that he was not and had never, in fact, handled production of document requests for the HOA.

Mr. Alzate’s affidavits contributed to lengthy delays in the investigation, excessive and frivolous litigation, and obstruction resulting in further victimization of the innocent members of the Hammocks community.
