Casey Anthony May Walk Free

Casey Anthony’s defense team has filed a motion seeking dismissal of the the first-degree murder charges against their client.

The defense maintains that the prosecution cannot prove first degree murder in the death of her 2-year-old daughter, Caylee, or that Anthony ever abused her daughter.

The defense states in their motion that, “Specifically, the state cannot establish whether Caylee Anthony’s death was accidental, natural, or the result of an intentional or negligent homicide.”

Casey Anthony has pleaded not guilty to killing her daughter and claimed that she was kidnapped by a baby sitter.

In the meantime, an attorney for George and Cindy Anthony, parents of the accused, released a forensics report which he said shows that the duct tape found with Caylee’s remains does not match the duct tape found at the Anthony’s home.  This is a key piece of evidence in the prosecution’s case.

The state has said that it has no intention of dropping the first degree murder charges against Casey Anthony and remain confident they can prove their case.

Meanwhile, the murder trial is not due to start until sometime in 2010.
