The State Attorney’s office said on Wednesday, no criminal charges will be filed in the investigation against Daniel Daley Jr, the 84-year-old man who Orlando Police said assaulted and battered an officer on September 18.  Daley remains hospitalized with a broken neck, after the police officer whom it was claimed he assaulted, used an “arm bar” technique to take him to the ground to handcuff him.
But, even as the State Attorney “considers the investigation closed”, Daley’s attorney, Mark Nejame announced that his client will be suing for damages, reports, clickorlando.com. Nejame has also called for a grand jury investigation into the incident.
Officer Travis Lamont, one of the investigating officers called to the scene of a disturbance between Daley and a tow truck driver outside a bar downtown Orlando, claimed that Daley was belligerent and continued to argue and slap him on his shoulder repeatedly. Lamont said he warned Daley not to continue to slap him, and he (Daley) grabbed him by his neck.
Lamont used the dynamic takedown procedure to get Daley to the ground.
Orlando Police Chief, Val Demings said last week that the incident was “tragic”, but that the dynamic takedown technique had been used for years by officers. However, she suggested that OPD’s use-of-force techniques, might need to be reviewed.
OPD is continuing with their internal review of the incident to determine the appropriateness of Lamont’s actions.
