Gov. Rick Scott on Monday criticized the state Supreme Court for its August ruling that when it comes to rule-making, the governor has to follow the ground rules set out in state law.
Scott had criticized the 5-2 ruling in Whiley v. Scott when it was handed down, calling it nonsensical, but he elaborated on Monday during an interview on the Internet radio program The Bob Harden Show.
Scott had set up a process under which he put several pending rules on hold for a review.
The Supreme Court said that the state Administrative Procedures Act (APA) governs rule-making, which is basically a legislative function delegated to the executive branch, and that Scott couldn’t go outside the requirements of the APA.
“The Supreme Court says an agency that reports to me, I don’t have the right to dictate whether they pass a regulation or not,” Scott told Harden. “How ridiculous is that? That’s what’s going on. We have a Supreme Court that wants to decide what the law is.”
