Two Orlando Police Department officers involved in an October 2023 shooting have been cleared of any criminal wrongdoing.
On September 26, 2023, officers were searching for a robbery suspect and came across Carlos Rosas in the area of Conley Street and Short Avenue in Orlando. Rosas pointed a gun at the officers who then fired upon him in return. Neither Rosas nor the two officers were struck by gunfire.
The Florida Department of Law Enforcement took over the investigation into the shooting and turned over their investigation to the State Attorney’s office.
The sState Attorney’s use of force policy requires all cases where deadly use of force was used by law enforcement officers to be presented to a grand jury to determine whether criminal charges are appropriate.
The Central Florida grand jury was presented with all relevant evidence in the case and returned a no true bill.
The use of force policy allows the grand jury to make a statement regarding policies, procedures and recommendations related to the use of force. The grand jury declined to issue a presentment on the case and chose not to issue a statement on the circumstances surrounding the shooting.
State Attorney Andrew Bain’s office has now closed the use of force case.
Rosas remains in jail and is charged with Robbery with a Firearm, two counts of Aggravated Assault with a Deadly Weapon and Possession of a Firearm by a Convicted Felon.
