Jury: Kelley not Guilty in Shooting Death of Boyfriend

It took an Orange County jury just over one hour to find Caryn Kelley, not guilty of shooting to death her boyfriend, Phillip Peatross, in 2011.

Kelley, a College Park realtor, who according to the state, offered up several different versions of what happened the night Peatross was killed said, she was relieved following her acquittal of manslaughter charges.

Expected to take the stand in her own defense, Kelley declined to do so saying, she was too emotional. However, she added that, she had no doubt she would go free.

Kelley’s attorney told jurors that Peatross accidentally shot himself, after he grabbed the gun from Kelly who had picked it up, thinking there was an intruder in her home.

Prosecutors argued that Kelley was culpably negligent for taking up a gun while she and Peatross were drunk.  In their view, this amounted to a manslaughter charge.

Asked what plans she has now that she is a free woman, Kelley said she is going to Disney.
