An 82-year-old Daytona Beach homeowner, shot and killed an intruder early on Thursday morning, Daytona police said.
Charles Robbins, 82 years, living in the 300 block of Woodland Avenue, grabbed his gun when he heard a banging noice and fired once killing Tyler Orshoski, 24, police said.
Orshoski, shot in the abdomen, was able to move off the side porch, where he died.
“We believe that the homeowner acted within his rights,” Daytona Police Chief Mike Chitwood said of the shooting.
Orshoski was wearing a stocking mask along with gloves on his hands. Police said, he was armed with a flashlight, screw driver and a hammer.
Police also said, there were pry marks on the door through which Orshoski was attempting to gain entry into the home.
Chitwood said, it is unlikely that Robbins would be arrested.
The investigation is ongoing.
