Casey Anthony Expected in Court

Casey Anthony, 22,  the Florida Mom, charged with first degree murder in the death of her two-year old daughter, Caylee, is due back in court tomorrow, December 11th.

Since her last court appearance, her defense team has filed a series of motions.  One such relates to Anthony’s check fraud charges.  Anthony’s defense team would like some of these charges thrown out.  They argue that she has been over-charged, given that she faces multiple charges for each check she stole.   The prosecutors have said each charge is a separate crime.

Another motion filed by the defense concerns the constitutionality of the death penalty.  In their motion, they argue that prosecutors don’t have sufficient reason to seek the death penalty and that it violates Anthony’s constitutional rights.

Legal experts share the view that removal of the death penalty would be a long shot.

Anthony’s defense attorneys have also filed a motion to have all recorded visits and telephone calls between Casey and her family destroyed.

One other defense motion concerns barring private eye Dominic Casey from being deposed.  They say  that at one time, Casey worked for the defense and any knowledge he has of the case is privileged information.

Judge Strickland who presides over the case has yet to rule on these motions.

Casey Anthony has maintained her innocence and has said her daughter was kidnapped by a nanny, although there has been no evidence to date, to support this.  If convicted, Anthony could face the death penalty.
