BoA Continues to Screw Home Owners, Yet Another Law Suit Filed

United Law Group filed a complaint (case number 1-10-CV-166846) on March 18, 2010 in the Superior Court of the State of California, County of Santa Clara, against Bank of America (BoA) and its subsidiary Countrywide Home Loans, Inc. for breaches of contractual obligations, violation of the Restatement (Second) of Contracts Section 205, emotional distress, and violation of California Business and Professions Code Section 17200.

This case states that though John Wright qualified for a mortgage modification under the Federal Home Affordable Modification Program (“HAMP”), he was denied access to the government-sponsored plan.

“I met the qualifications for HAMP and with United Law Group helping me did everything the bank asked,” said Mr. Wright.

Mr. Wright continued to make the required payments in a timely manner and called Bank of America frequently to ensure the success of the process. Each time he was told not to worry.

“At one point a bank representative told me that I had nothing to worry about because I’d done everything right,” said Mr. Wright. “I satisfied the financial terms of the trial modification and submitted the required documentation before the August 2, 2009 deadline, but Bank of America still sent a Notice of Intent to Accelerate.”

At the completion of the Trial Period Bank of America claimed it did not have the necessary paperwork. Despite multiple attempts by Mr. Wright to fax, re-fax and submit the documents by certified carrier, Mr. Wright received a letter on February 16, 2010 refusing his loan modification and demanding that he pay a lump sum payment or risk foreclosure proceedings.

“John Wright and his financial situation have been abused by the bank to the point where litigation is his only recourse,” said Robert Buscho, Managing Attorney for United Law Group. “Unfortunately, his case is not unique. Millions of innocent, hard working citizens are being misled and abused by the banks. Unless homeowners take a stand this will not change.”

United Law Group takes an aggressive stance against predatory lending practices and is an outspoken advocate on behalf of honest citizens who have been hurt by the housing and mortgage crisis.

“We filed the case on behalf of Mr. Wright because the banks cannot be allowed to continue to blatantly disregard this crisis,” said Buscho. “The United States government has asked banks to be a part of the solution and has gone so far as to use taxpayer dollars as an incentive. We are simply carrying the torch lit by our officials to shed a light on and hopefully remediate predatory practices.”

“The banks use misinformation and misdirection until you can’t distinguish the good guys from the bad guys. They make you afraid to get help,” said Mr. Wright. “It’s ironic to me that United Law Group’s reputation is in question right now. They’ve been honest with me throughout this ordeal and I count my blessings that I have United Law Group on my team.”

The firm made the news recently when a team of officials entered their offices to evaluate the work they are doing for their clients.

“It’s been the banks that have mislead the public,” said Mr. Wright. “United Law Group could have shut their doors and stopped helping people after having their practice was questioned, but they didn’t. They were in the midst of preparing my case before it happened and their attorneys filed my suit against Bank of America seven days later.”

    When I filed my lawsuit against Bank of America, myself and United Law Group thought of the many others out there in the same situation. It was then that we decided to educate the public on what these piggy banks are doing, as well as unite us all together as one voice.     On 04/23/10 Patricia from Bank of America called me. She said she could not speak to me because I am in litigation with BofA. Apparently, she is a CEO and really high up there. You should call her and ask her about your modifications and say “I support the John Wright Vs. Bank of America Lawsuit.” The number she called from was: 818-713-2886.

    Is this counting the bail out we gave them? We have learned “Bank of America is one of the world’s largest financial institutions,” but I am not sure that “serving individual consumers, small- and middle-market businesses and large corporations with a full range of banking, investing,” is true. Notice we did not see “Bank of America is one of the world’s largest financial institutions giving American’s the modification we promised!” Instead, I read their press release of how much money they are making!!!! The money that they made potentially on the very Tax Payers that they schemed! It is called insult to injury! I think even the President of the United States felt tricked by their potential false promise.

    So I would like to play a game of truth or dare with Bank Of America.

    Truth:
    Did Bank Of America make any money on the bail out we gave them?

    Dare:
    I dare BofA to give the following press release: “Bank of America is one of the world’s largest financial institutions giving modifications to the American Tax Payer!”

I applied for the Federal HAMP in June, 2009 through Bank of America and was sent a letter from BofA yesterday, July 22,2010, stating that I was not eligible because I did not provide the bank with the documents they requested. I did provide everything to them at least 3 times and called them many times, which I have documented. I was on the phone with them last night for about 40 minutes and the BofA employee, named Eliseo, informed me that they showed I had missing documents in April, which I did send in FedEx overnight before the deadline, and he also told me that I told a BofA employee named Nilesh B. that I had declined the Federal HAMP, which I never did such a thing. I have worked very hard trying to get approved for the Federal HAMP. Eliseo, the BofA employee told me on July 22, that I would have to call the BofA Hope Team and discuss my matter with them, which I tried to call them but a recording came on with their operating hours, and I’m assuming they were closed by that time. I’m going to call them again on July 23, 2010. I would appreciate any advise you could offer me. Thank you! Jo Ann Viands
