AG Appeals Judge’s Ruling on Foreclosure Mill

Attorney General Bill McCollum has appealed last week’s ruling by Circuit Judge Jack Cox that, the Attorney General could not investigate the Shapiro & Fishman law firm for its alleged involvement in presenting fabricated documents to the courts in foreclosure actions to obtain final judgments against homeowners.

Judge Cox in his ruling said that the state attorney general has no power to subpoena or investigate law firms, including Shapiro & Fishman. He rejected a subpoena filed by McCollum seeking information regarding the foreclosure practices of the law firm Shapiro & Fishman.

But, AG McCollum sees it differently and has filed a motion for a rehearing of Judge Cox’s ruling.

The Attorney General is currently investigating four law firms, The Law Offices of Marshall C. Watson, P.A.; Shapiro & Fishman, LLP, the Law Offices of David J. Stern, P.A., and Florida Default Law Group, PL for allegedly engaging in these practices.
