Calling them suspicion-less tests that are unconstitutional, the American Civil Liberties Union (ACLU) on Wednesday said it has filed suit to block an executive order signed by Gov. Rick Scott in March that requires drug tests for all new hires and randomly selected existing workers in agencies under the governor’s control.
The suit was filed in federal court in Miami Tuesday on behalf of a Florida Fish and Wildlife Conservation Commission employee and the American Federation of State, County and Municipal Employees Council 79, which represents 50,000 public workers now subject to the new drug-testing regime.
The announcement comes a day after Scott signed another drug testing bill into law. That measure, which is also expected to be challenged, requires all welfare recipients to undergo drug tests before receiving temporary financial assistance.
